I am a 49 year old, disabled woman; I have been bringing, up alone; ( since charges were brought forward, on the bio., father of Domestic, and child sexual abuse, to children under the ages of 5, on down to an infant);1997. I am a colleg graduate, unable to work, since 2000, on SSDI.. Oldest son now 19; has Cerebral Palsy, with secondary conditions; all three have required counseling, and some medication, since that time; ( I have total legal and Physical Custody). Reason stated; you can imagine how much sacrifice and sress/anxiety; expense, financially and physically/emotionally, the toll has been, since that time, 100% alone.
CASE: Middle dtr., at time was 16, now 17; had a very bad boyfriend, of which I sought re-straining order upon, approx., and on the date in ?, had to pick up from HS., as he was missing; not yet served; and at age 20, was not allowed by law or me for her to see; she of cource, disagreed; her temper flairing, from 10am to 3pm, in and out of my vechicle, errands required, that day; trying to get back home in time for my youngest, 14 at time, female, in alot of school related traffic. Her constant yelling. An officer, admittingly, going off duty; made a late stop, of my vechicle, in which he testified, there were 3-4, he thought, went through a red light; singled out mine; as he sat 1/4 down hill in his own traffic, at a red light; stated he stopped me for going straight, on a left turn arrow, which I initially was forced/merged into for seconds, with heavy traffic taking lanes, they should not have; beside the point; I immediately, put my blinker on and “immediately, as we sat at a red light, another VAN heading my way, motioned me to go ahead, in front of; and thus, in correct lane, when light turned green, and moved forward to next light, red, with still heavy traffic, and no indication, of police lights or an emergency or other in progress; both lights,, and upon green light to make left turn onto Lund RD., near Bishop Guertin; it was noted by all vechicles, that an officer put on his siren and lights; ( by us all moving to the right, for him to pass, as is the law). He stated he waited, with no explanation, other than watching me! What did I do? He proceeded, to my vechicle to my surprise, and heard yelling in my van; ( already stated bove, per teenage dtr., angry about restraining order); he asked for licsence and reg., I asked nicely; can you please tell me why you need these items; he just repeated himself 2x; as I began to get items, he finally stated, he stopped me, for going straight, on red arrow. I explained; ( what I stated above, per van, allowing me in correct lane., immediately); He then agitated, came to my direct driver window, facing me flatly; his eyes blulged out of his head, and said; ” and you and other cars blew a red light”!! He then left for a periood of approx., 10 to 15 mins., my youngest called and was locked out of the house, and this kid on the run; I was even more worried now for her; ( I saw his aggressive tone and, called the Nashua Poilice, to ask , if I did anything wrong, did not get to report state , of fear I was in due, to his state/demeanor / stance he took; with my already distressed angry dtr., in the vechicle/ behind me drivers side); as suddenly he appeared back, I told him I was on the line with his station, and if he wanted to speak with them; perhaps a dumb request, on my part, hindsight, angered him more; officer on phone went from helpful tone, to when his fellow came back to I can’t help you…I note importantly here; my vechicle was in park safely; doors auto lock, windows on my and passenger side wide open; seatbelt still on; and as he said I am placing items hear, on my Odessey’s bubble dash board, still on phone with police station, it is recorded what I said happended; Said no wait, in panick, not finished; he began to walk away, I was begining to hang up cell phonee, papers blew x2 of 4 out the window,, I was able to slap down to the dash thee other two, thought he was gone, ( However; suddenly; he said, appearing back at my window, status inside van the same.(.”ALRIGHT, THAT IS IT, YOUR UNDER ARREST). You can hear me say, 2 more times, more hysterical, wait a minute, I am not done); as” the officer is now banging,by pulling me toward him; ( as if I would come, out the driver side window); which banged my whole left arm; shoulder and side of body, against the closed door; I could not speak, and say let me undo my seatbelt, which now had tightened to the point, of pining me against my seat; I grabbed, my steering wheel with my free hand, right, to lesson the blows, as well my daughter, leaned forward, and was now holding my shoulders back). I could hear children and mom’s all along side me screaming, at him to stop, the little boy I heard began crying; ( those parents, daily, have to sit in a long line, and wait, for the Bishop Guertin Students, to be dismissed, and take them home). My seat belt tightend, as he pulled, and my dtr., leaned forward and was holding my shoulders back; Thus, he was out of control; at that time,I did not know why and, did not, until events were over, and at Police station); as proven in trial. He suddenly stopped pulling, I turned away from him, and tried to release the seat belt, and conform; BUT; could no longer reach it, due to the seat belt and dtr, hold; when I turned to tell him, he unloaded a canister; ( yellow), of a foam spray; all over my face and across my eyes; hitting my daughter as well; I was then paralyzed and could not beath or see; “heard the officer flick my door knob, and could not opn my door then heard him unlock it; felt him come across my body and un did the seatbelt; pulled me out like a dog, in front of everyone, and my daughter, now screaming in pain and fear; to the tar road; I was in a fetal position, with hands over eyes, trying to breath; he grabbed my arms; ( he was shaking and sweating the whole time); placed without resistance, very tightly, handcuffs; then threw me in the back of his hot; still running police car; windows up; locked me into the seat loop, behind me; left me there 20 mins., I felt I was definetly going to die; as I already have medical condition, with throart; and swollen vocal cords; ssuffocating, praying; same time could hear dtrs., distress; and still minor at home aone locked out; 2 ambulances showed up eventually; to treat my dtr., and I; I could not get the medical treatment, as an arriving officer, sarcastically, laughing at me; refused to allow them to take me to emergency room, as requested, with ambulance driver saying, that is her right! On the scence officer wisely asked me what medical problems required it; I could only mumble; told of felt like having a heart attack and tried to state various medicals; he jumped in and said tuff; that is just the effects of the spray!” Ambluance driver tried, to allow my rights, heard same on arrival to scence officer; tell the arresting officer; ( very subdued now, and hand, on my back shaking, like a leaf; which I requested, him to take off my back, he did); “just hurry up and put her in the car now”! HE DID; shut the door again; and went away again for another 10-15 mns., he said later to direct traffic. Kept trying to talk to me, telling me how to relieve the condition; ( telling me stories of his partner once hitting him in the eyes and what a “B” it was); I responded very qiet I can’t talk sir I am trying to breath. He then figured out he was the actual officer asigned all day, to find the man; I had the restraining order on; and how diligent he was; I just said thanks…Wanted to go to hospital, and was deeply thinking, trying to gather myself, and breath, to get to my children, we got to the staion, and the woman officer said; ” hey; too many times seeing you in three days”)!
( She had responded, to my home, when, the same daughters’ ” pyschological couselor”, was, on the phone, with me ,as she tried to jump off, my farmers porch, outside her bedroom window, with a ack pack, to run away with him; and I ran to stop her, successfully).( recognized her voice, then was able to partially open eyes, by time, bail bondsmen came and, got his cash)! Asked officer, why I was arrested; I asked, as heard, on lawyer obtained booking tape; ” what does that mean”, after she said; ” thats’ IT”! He said Littering, and resisting arrest; I was heard saying, “NO; my seat belt was on and I couldn’t get out/trapped inside”. He said nothing, became, very nice and apologetic, coming, to my cell 2-3x, asking me, what my dtr., was yelling;( which he later, put in the report, as I said to him, at scene)! Got my keys so an officer could drive them out to kids; stranded for hours, new neighborhood, and man not caught yet/served! 2 hours or so later, I payed, only to find van impounded; now needed to be resourceful, found someone to get me there and drive me home, while wife followed, in her car, as I could not see still.

Prosecution, did not have a case; tried to have my ATTORN., cut a deal 3x or more, they would drop the red arrow and littering; but NOT the resisting arrest; my attorn., Dawkins, Manchester; tore his statememnt apart; my dtr., outside court rm., whole time, witness; called in confirmed everything, even with prosecution trying to fumble her up; BUT; the truth is the truth; no mistakes. Then me; she was so flabergasted, she finally said; ” I’m Done”, frustratingly sat down with hands on both side of face. Judge said; take under consideration. More than two months passed, no answer; which Attorn., Dawkins found odd, but prefeered we wait; and wait; and wait;, April 3rd 2010 trial; today; 6- 9- 2010; still nothing.

Attorn., dawkins happend to be in Nashua today, for another matter, requested, my file; and to his amazement; found the judge rendered the day after..April 4th! GUILTY on Littering and resisting arrest…Still no documents to his office or to me? He made a copy and sending them to me; and does not think I have an appeals option. I would not have spent over 2,000.$$$, on an attorn., if guilty; would have the court appointed assigned, have me state No Low, with a fine and suspended descion for one yr., good behavior.
However; what they did; how theyy got away with hurting us; lieung about any of it; I did not like admitting guilt, when none was done by me; but them…What did the nashua judge do; simply look at me as revenue; a number on the dockett; and with NO proof even to reasonable doubt, checked off, two boxes; “GYUILTY”!!!!! I want to APPEAL; SOMETHING! I am a volunteer at Church; school disrict; and prof., when can return; work with disabled. NOW with this, I can not! Plus what happend to innocent? Judges and police stick together, Nashua NH>>> HELP?
